The evicted tenant from Alcalde Sáinz de Baranda will return to her home with a new eight-year lease and a rent that will not exceed 30% of her income. The agreement, mediated by the EMVS, must be ratified by her, as she remains hospitalized at Gregorio Marañón.
Maricarmen will be able to return to the property on Alcalde Sáinz de Baranda in Madrid, from which she was evicted last Wednesday. Her representatives and the property owner, Urbagestión, reached an agreement on Monday after more than four hours of negotiation, as reported by miracorredor.tv.
The Municipal Housing and Land Company of Madrid (EMVS), dependent on the City Council of the capital, mediated in the negotiation. The understanding must now be ratified by Maricarmen, who continues to be hospitalized at the Gregorio Marañón Hospital.
The new rental contract will last for eight years and the rent will be set according to her economic capacity, ensuring it does not exceed 30% of her net income. Her lawyer, Beatriz Duro, has indicated that the amount will be approximately similar to what she paid before the eviction.
The solution has come after the eviction took place," lamented the lawyer, who has positively assessed the agreement.
The intention is to expedite the procedures so that Maricarmen can return directly to her home when she is discharged from the hospital, provided she accepts the agreed conditions. Her belongings remain inside the property.
Maricarmen had been living in the apartment since 1956 under an old rent contract initially signed by her father, which she later took over. Urbagestión acquired the property in 2018 and went to court, considering the lease to be terminated.
Although an initial ruling was in favour of the tenant, the Provincial Court ultimately ruled in favour of the property owner, and the Supreme Court did not admit the appeal filed by her defence in December 2023.
The eviction was carried out last week on the fourth attempt, after several mobilisations to try to prevent it. Maricarmen was taken out of the building on a stretcher and subsequently transferred to the Gregorio Marañón Hospital.
The return to the property will occur once Maricarmen is discharged from the hospital and accepts the conditions of the new contract. Until then, her belongings will remain inside the apartment.
