The Administrative Tribunal for Public Contracting of the Community of Madrid mandates a redo of the tender for the 18 Comprehensive Women's Care Centres. Meanwhile, current contracts will be extended.

The Administrative Tribunal for Public Contracting of the Community of Madrid has partially upheld the appeals filed by Comisiones de Base (Cobas) and Comisiones Obreras (CCOO) against the tender for the 18 Comprehensive Women's Care Centres (CIAM) of the Madrid City Council. According to epe.es, the body concludes that the procedure cannot continue with the current terms and that a new tender must be called.

The resolution annuls the clauses regarding the establishment of minimum services in the event of a strike and those regulating authorisations for personal, professional, academic, or union activities. The rest of the unions' claims regarding working conditions and the organisation of the centres are dismissed.

The tribunal believes that the modifications affect the conditions under which companies prepared their bids:

it is not legally appropriate to continue the current tender based on terms that must be modified

The tender consists of five lots, has an estimated value of €50.7 million, and an initial duration of 24 months, extendable for another two years. A total of 14 bidders submitted proposals. The tribunal had suspended the procedure in September, and the new resolution formally lifts that suspension.

Municipal sources indicate that the City Council will call for a new tender with the corrected terms. According to those same sources, the tribunal only requires adjustments to two blocks of clauses: the minimum services in the event of a strike and the dissemination of service information.

The municipal government maintains that the tribunal has sided with the City Council on the main issues, such as staff substitutions, the economic sufficiency of the contract, work hours and staffing needs, and the reorganisation of resources.

While the processing lasts, the current contracts for the centres will be extended to ensure the continuity of care at the CIAM in the capital.
