El Escorial Town Council has decided to appeal to the Supreme Court against the ruling that annuls the Montencinar redevelopment project.
The Town Council of El Escorial will file a cassation appeal before the Supreme Court against Ruling 943/2026 from the High Court of Justice of Madrid (TSJM). The ruling upholds the appeal from the Montencinar Property Owners Association against the redevelopment project, as reported by capitalnoroeste.es.
The mayor, Antonio Vicente, and the councillor for Urban Planning and Environment, Soledad del Valle, informed the three residents' associations of the urbanisation after analysing the municipal legal services' advice. The specific interest for cassation will be detailed in the document that is currently being drafted.
Since 2020, six contentious-administrative appeals have been filed against the decision of the Local Government Board on September 5, 2019, which definitively approved the Redevelopment Project of PERI 3 Montencinar. The lower courts dismissed all of them. Three were appealed to the TSJM: two were dismissed, and the one that reached cassation before the Supreme Court was inadmissible.
In total, the judiciary has ruled nine times in favour of the Town Council and once against it. The processing of the urbanisation project cannot continue until the appeal is resolved, as the ruling annuls the redevelopment, a prerequisite for executing the works. The council will bear the cost of the administrative actions taken so far.
The deadline to file the appeal is thirty days from the notification of the ruling. The formal admission, referral to the Supreme Court, and preparation of the document will take about three months. After that, the Court will take between six and eight months to decide whether to admit the appeal, and if it does, it will issue a ruling within an indeterminate timeframe.
